As long as that legal directive is established upon reading the
Federal Register 45 CFR Parts 160 and 162
Health Insurance Reform: Standards for Electronic Transactions;
Announcement of Designated Standard Maintenance Organizations;
Final Rule and Notice
And not from reviewing an Implementation Guide which is a tool
that the Final Rule identifies to assist with the implementation
of the Final Rule.
As Karen said READ THE RULE. The Implementation Guides are for
the technical implementation of the transactions, not defining the law ...
if you want definitions go to the Rule.

And it is probably a good idea to consult with your company's legal counsel
if there is any doubt about your particular situation. I for one would much
rather have our attorney's directive in my hand as opposed to a copy of
messages from a listserve if I'm ever questioned as to why a particular
strategy was chosen relative to an ambiguous HIPAA issue.
