Creating an "empty" 834 is syntactically possible I suppose...table 2 (the INS loop - Loop 2000) is not mandatory in the X12-4010 standards. However the implementation guide named for use under HIPAA does state that Loop 2000 is REQUIRED, hence at least one member is expected to be sent in a HIPAA-compliant 834 transaction.
Administratively my clients have dealt with this issue by setting cut-off times for transmission receipt. For instance I have a client whose rules say if the 834 isn't received in the client's secure mailbox by 23:00 each workday from its employer groups, then it is presumed that there was no data to send that day. The client's batch process for processing enrollment kicks off around 23:15 (barring production problems...but that's another story!). If the employer misses the deadline, they can send two files to the mailbox the next day.
