Hi, Charles,

I would imagine that the FCC would respond the same way they did when
33.6 came out.  It required companies to have signal power testing done
and modification filings submitted.  At the time, Rockwell said that
there was no difference between a 28.8 kbps carrier and a 33.6 kbps
carrier except the constellation, so no testing should be required. 
However, it was also argued that the constellation is part of what
defines what is transmitted, therefore testing _is_ necessary.
