The standards are the same. Depending on how you implement your modem, as a 
plug-in card verse integrating it to the mother board you may run into 
issues with obtaining host indpendant approval. In the countries we have 
approved our reference design software modem it has not bee an issue so far.

Not exactly true, you will still have a DAA and the associated interface 
devices that interact between the host bus and the DAA.
