However, if the question was general, than may I assume that the question is related only to mandatory technical regulations and not to voluntary performance requirements ? The global trend is towards limiting telecom regulations to issues having to do with whether the equipment causes network harm, and away from performance requirements. (There even is a trend to global agreement on what constitutes Network Harm. Read the proposed new CTE Directive, or Part 68 of the FCC Rules and Regulations). The regulator does not care whether the network harm is caused by software or hardware, but needs assurances that whichever way you control the paprameters of your product (hardware, firmware or software) that mechanisms are in place that ensure that no network harm will be caused and that the end-user cannot readily make changes that would violate the conditions of approval.
