8 countries currently accept TBR 21 as an alternate national standard so 
there is no CE marking going on, you apply for national type approval and 
put your label(s) on as usual. We have obtained over 50 type approvals using 
this route. A couple of countries have additional requirements on top of TBR 
21 but any lab designated to carry out TBR 21 testing is allowed to add 
these.

BUT, speaking about confusion:

A lot of equipment have functions which fall outside the scope of TBR 21. 
These functions (pulse dialling, register recall, series-connection etc) 
have to go through additional testing according to the respective national 
standards. Unless the various Notified Bodies suddenly decide to recognize 
test results from "foreign" labs we are still stuck with the extremely 
expensive european sightseeing for these products.

Considering that the old Directive about mutual recognition of test results 
(from 1986) is still not implemented we will probably continue to visit all 
those beautiful cities of Europe. I don't mind........

There is no difference between a TBR and a CTR.  TBRs are produced by ETSI
(European Telecommunications Standards Institute) who have a mandate to
publish standards, not Technical Regulations.


A CTR is a TBR that has been accepted by the appropriate European
authorities
as a Common Technical Regulation.  (CTR).


Therefore, you buy the TBR from ETSI.  You'll only know whether it is a CTR
(Common Technical Regulation) if you see a notice to that effect in the
Official Journal (OJ) of the European Communities.  So far, TBR21 has not
yet received the required approvals from the appropriate authorities.  It
should happen "soon".


A number of national authorities in the European Union apparently is
accepting equipment that meets the requirements of TBR2, even if it is not
yet a CTR.
I have seen any number of announcements on TREG to the effect that this or
that country will accept equipment that conforms to TBR21 but do not know
about the legitimacy of those statements.  That is, if you try and import a
piece of equipment into one of the member states and they won't accept it,
can you go back to them and say "BUT IT SAID SO ON TREG ?"


I believe that what is really happening is that some European Notified
Bodies, fed up with the dilly-dallying, will allow you (if your equipment
meets TBR21) to affix the CE-marking with their Notified Body number.  I
assume that happens with the tacit approval of the local Competent
Authorities.  Any other local authority can take exception to that use of
the CE-marking.  If they are wise, they won't.
