Here you have the usefulness of Notified Bodies.    If their interpretation
is wrong,
you can share the blame.  All you've got to do is to find a notified body
that sees things your way and get their approval.  That decision, like any
other can be argued about, but in the mean time you have authority to put
the EC Marking with their number on the equipment.
