The Declaration of Conformity can only be made by an Australian based manufacturer or an Australian based importer. Thus an overseas manufacturer requires to supply his Australian importers with the compliance folder documentation. As the importer is the only body recognised by ACA the importer must satisfy himself that the changes satisfy the requisite standards. The Australian importer is required to authorise the overseas manufacturer to apply the importers Label to the goods (in writing ) The Compliance Folder shall contain copies of all agreements, authorities and appointment of agent made by the importer. As far as your ugrading from 56K to V90, if this upgrade does not affect the PSTN interface performance of the modem such as DTMF, transmission level, DC characteristic, etc.... You do not need to retest the modem as long as you keep in your compliance folder what have been change from earlier version and enough evidence that the PSTN parameters do not change. On the other hand, due to the new regulation in Australia You do not have any approval number for the product anymore.
