There are some additional factors to those outlined by Aaron & Kevin to be
considered.

The Declaration of Conformity can only be made by an Australian based
manufacturer or an Australian based importer. Thus an overseas manufacturer
requires to supply his Australian importers with the compliance folder
documentation.  As the importer is the only body recognised by ACA the
importer must satisfy himself that the changes satisfy the requisite
standards. 


The Australian importer is required to authorise the overseas manufacturer
to apply the importers Label to the goods (in writing )  
 
The Compliance Folder shall contain copies of all agreements, authorities
and appointment of agent made by the importer.  
 
Further information is available on the ACA Website where the Labelling
instrument is listed together with several amendments. depart  
 
Overseas manufacturers exporting to exporters or exporting direct to
customers in Australia should obtain detailed advice.

Just a slight correction to Aaron Bui's comments.

Essentially what Aaron suggests is true, however, nothing is
 required to be sent to the ACA. ie
It is not required to LODGE the DoC (Declaration of Conformity)
with the ACA.  The DoC is prepared, signed and then placed in the
 Compliance Folder.  Immediately the DoC is signed, the product
may be offered for sale in Australia.

Hi Cynthia,

In Australia, the approval is now self-regulation. As far as your ugrading
from 56K to V90, if this upgrade does not affect the PSTN interface
performance of the modem such as DTMF, transmission level, DC
characteristic, etc.... You do not need to retest the modem as long as you
keep in your compliance folder what have been change from earlier version
and enough evidence that the PSTN parameters do not change.

On the other hand, due to the new regulation in Australia You do not have
any approval number for the product anymore. You will be issued with the
supplier/manufacturer number and your responsibilty is to keep a Compliance
Folder containing the test report from the accredited test house and lodge
the declare conformity of the product with ACA before selling it in the
market.
