Just a slight correction to Aaron Bui's comments. Essentially what Aaron suggests is true, however, nothing is required to be sent to the ACA. ie It is not required to LODGE the DoC (Declaration of Conformity) with the ACA. The DoC is prepared, signed and then placed in the Compliance Folder. Immediately the DoC is signed, the product may be offered for sale in Australia.

As far as your ugrading from 56K to V90, if this upgrade does not affect the PSTN interface performance of the modem such as DTMF, transmission level, DC characteristic, etc.... You do not need to retest the modem as long as you keep in your compliance folder what have been change from earlier version and enough evidence that the PSTN parameters do not change. On the other hand, due to the new regulation in Australia You do not have any approval number for the product anymore.
