It is fine to use HTML5 and CSS3, as long as you don't use the DRM features.
Try not to require JavaScript whenever possible. JavaScript can however be run in freedom just fine, like most plugins. The use of the Expat (“MIT”) license is very frequent in the Web development world, whereas the GPL is unpopular.
