I'm on the fence as to whether or not this a freedom issue.If it is, there are third-party flash-carts that can run homebrew software, although there is very little homebrew software for the N64.
I would recommend the Nintendo GameCube over the 64-- the GameCube can run a large amount of free software, such as GNU/Linux!
