The headline of that news is "Security is Not a Crime—Unless You're an Anarchist". So, it's not "Extreme security robustness can land you in jail in Spain" but rather "Extreme security robustness AND being member of an organization that sets bombs in ATM machines can land you in jail in Spain".

There's no law against using secure mail in Spain, but in spite of that the judge of that case chose to consider the use of it as one of the grounds for temporary prison for some of the detainees. This has only happened once as far as I know, and I think it to be the kind of mistake that can be reversed by an upper court. Still sad anyway.
