Version 38.8.0 was the last release of Firefox ESR in the 38.x series, and
after that Firefox 38.x became EOL. Firefox ESR has now switched to 45.x.
The stable Tor Browser switched to 45.x just after it was released. Looking
at the Tor blog, Tor Browser 6.0 was released on the 30th May 2016:

The reasons for not upgrading IceCat are similar to the reasons for not
upgrading from Windows XP, in that you lose one feature or two. These are
quite obscure features, not really used by the average user - why not write
an add-on that gives the same functionality? However, it gets no security
updates which is essential for the browser.
Point is, there are no real reasons not to upgrade other than a lack of time.
Use a different browser; you can also use upstream Firefox and add the
privacy features you need.
