In my point of view, when a perpetrator acts he makes an overt act, and the victim receives an overwhelm. Both of them (perpetrator and victim) are playing that specific game on behalf of their personal goals and limitations. The victim, because she suffers and is aware of her suffering, is (and feels so) punished. But she CAN (if she wishes) be educated by TROM to prevent such overwhelms. The perpetrator, on the other side, is punished too, but he IS NOT AWARE of that (with TROM we know that). So he MUST BE EDUCATED to eliminate his misbehavior. This forced education is the only purpose of the justice. The jail is the school, not the revenge. However, the majority of the people understand justice as a official revenge, and jail is a very poor school, but this is another problem. So the victim is 100% responsible by her punishment (but normally is not aware of that), and the perpetrator is 100% responsible by his 2 punishments, too. The first should look for education for prevention, the second must be forced to be educated for prevention. So the perpetrator is punished twice. The first punishment is the charge he gets with his over act, and usually stays on reactive mind. The second punishment is by the overwhelm received from justice (forced education on jail).
