I understand where you're coming from; I see prophecy as predictive as well
and I think God was telling the mother that the younger boy was to be as the
firstborn... not because deceit would accomplish this, but because it's part
of the overall plan of preferring the underdog.

I place the blame of deceit on Rivkah, for it is written, "Two nations are
in your womb... and the older shall serve the younger." She took it upon
herself to assure God's plan came to fruition when she said "Now therefore,
my son, listen to me as I command you... you shall bring [two choice young
goats] to your father, that he may eat, so he may bless you before his
death." Jacob didn't want to perform this task for he said, "Perhaps my
father will feel me, then I will be as a deceiver in his sight, and I will
bring upon myself a curse and not a blessing." Rivkah said, "Your curse be
on me, my son; only obey my voice, and go, get them for me."

God, it is the observation of the future for He can see it as clearly as He
does the present or the past.  Does prophecy tell us that Jacob is the
"rightful" owner or is it giving us God's view of the future.  That it will
happen is different form that it should happen, if you see what I am saying.
And what is the point?  Jacob and his mom did not see this as his
irthright  --  that is why deceitful measures were taken.   Do we have a
circumstance, here, in which God has made some kind of pronouncement about
the birthright (if so where) and Jacob et al have decided to "help" God out
....  if, in time, God would have arranged this transfer apart from lies and
deceit?
