Do you run tup via cygwin, or does it use any parts of cygwin? If that
would be true, maybe try msys?

I was using tup on Windows 7 with gcc and did not observe the issue you
describe... I did not look at timestamps, but the rebuild was only done
when required.
Are you using the most recent tup version?
