I think creating some kind of zone of privacy around events like funerals and going to a medical facility is consistent with the first amendment, so I think there is a way to handle this situation without gutting free speech. There is no question that stepping up to pay the legal costs is a mitzvah,* *no matter the motivation or source, and I appreciate that it has happened.
