The incident that I believe you're referring to occurred in 2008 at the 
now-demolished version of Yankee Stadium; the city settling the lawsuit 
happened in 2009:

At the game at the new Yankee Stadium I went to in June 2012, I saw no evidence 
of "God Bless America" enforcement -- consistent with the Yankees' 
clarification of the current policy (or non-policy) quoted at the above link.

You don't even have to take your hat off, despite what a few stadium announcers 
will tell you to do.  (I have a feeling that at some point in the future, I'm 
going to get yelled at for this by a fellow fan.)

I do find it a little bit amusing that in God-fearing Orange County, the Angels 
play it only on Sunday, but up in godless Hollywood, the Dodgers play it at 
every game (at least, this was true as of last season).
