It's not number 2: the courts (and I'm sorry I can't grab the actual case)
have ruled that statistics from sporting events are considered facts. It
went back to an MLB case where they tried to shut down every fantasy
baseball league because they "owned" the data from their games. The courts
ruled (IIRC) they couldn't own a public fact (since their games were public
events) or a compilation of said facts.

Sidebar: at some point the NHL's big annual fact/record book had a "Terms
Of Use" section trying to argue the same thing.
