I disagree -- this is indeed a bug. If it's not possible to upgrade the kernel, that's fine. But in that case, the kernel version should be locked for live CD / live USB bootups. (e.g. in Synaptic via "Lock Version" in the "Package") Currently, "sudo apt-get upgrade" is forever broken, because it always tries & fails to install the kernel update.
