Daniel, I agree with you and disagree with my previous comment. Due to the number of users experiencing this issue, this is indeed a bug. From a user point of view, the upgrade should be locked or at least should not fail if the package is not upgradeable. Since my aforementioned comment, bug 292159 has been chosen as the master report, and all other report will be attached to this one.
