I had the same problem. I also upgraded from 9.04 to 9.10 and my atheros
5001 didn't work at all. Iwconfig had exactly the same output.

Turns out its a bug in Ubuntu. The problem is that in:
/etc/modprobe.d

There is the file:
blacklist-ath_pci.conf

Which has in it this:
# For some Atheros 5K RF MACs, the madwifi driver loads buts fails to
# correctly initialize the hardware, leaving it in a state from
# which ath5k cannot recover. To prevent this condition, stop
# madwifi from loading by default. Use Jockey to select one driver
# or the other. (Ubuntu: #315056, #323830)
blacklist ath5k

Which blacklists atheros 5k wifi cards throwing the responsibility for the to 
Jockey. The problem is that Jockey handle at all atheros cards in 9.10, so 
there is no way to enable the wifi card. By commenting out the "blacklist 
ath5k" line as such:
#blacklist ath5k

everything starts to work beautifully. I think that the blacklist-
ath_pci.conf should be deleted whenever an update to 9.10 happens.
