Of course it's a kernel bug, no matter what an application does it shouldn't be able to crash the kernel unless it's explicitly trying to do so. On that note, I tested this against kernel.org a while back and didn't have the problem (with the intent of adding it to the kernel bug tracking system, and also get a 'kernel' project tag so it gets fixed), but it didn't happen, either random luck or it's fixed upstream. I think it's related to the usb capture code.
