I had the same symptoms ("iwlist wlan0 scan" returns "blah blah failed:
device or resource busy") when returning from suspend. Not always, but
from time to time and on different ubuntu versions over the last maybe
two years. Haven't noticed it anymore for a few weeks though. Running
up-to-date 10.4
