Noticed one other thing... hope this all makes sense... I think the volume is defaulting to max, the reason I thought the issue was fixed was because for some reason ALSAmixer was set to 0 and the volume slider was set to max after running the log, because ALSAmixer was at 0 max on the volume slider wasn't vary loud in fact it actually ended up right around my normal volume level and after further tests max volume and the volume before moving the slider appear to be exactly the same.
After adjusting ALSAmixer back to where it should be the issue is back where we started.
