It's certainly invalid against the kernel, since the problem is in a gconf setting. From what information I see the best explanation seems to be that touchpad-indicator is at fault, but that doesn't appear to be an official Ubuntu package. My suggestion would be to file a bug with whoever provides touchpad-indicator.
