One reason "use global menu only for maximized windows" is a bad idea because you shouldn't be trying to encourage people to be maximising windows. The reason we have larger screens is so we can fit more than one window on the screen at any one time, I usually have several. Microsoft Windows users are the main culprits of the "maximize everything" culture and this is not something anyone should be aiming for.
What OSX does with it's permanent menus actually works well and I've never heard any complaints about it. Everyone who has been forced to use Unity at the company I work for has complained about this particular aspect of it.
