Thanks Fred. Yes the fix is simple enough, add the word "persistent" to the /boot/grub/grub.cfg vmlinuz kernel lines. This bug still affects 13.04 also. I find persistence useful for setting up my install media with additional wireless/ethernet packages which may be needed on some machines. A Toshiba Satellite under 12.10 had neither working wireless nor ethernet (until the first kernel upgrade), so I set up the wireless rt8723 module build and the boot-repair deb on another machine, to make the Toshiba installation easier -- Ha.
