Tested with Ghostscript 9.09rc1 in Saucy and here the crash is fixed.
There is an error message:
till@till-twist:~/ubuntu/ghostscript$ ps2pdf toc.preview.eps
GPL Ghostscript RELEASE CANDIDATE 1 9.09: ERROR: A pdfmark destination page 4
points beyond the last page 1.
till@till-twist:~/ubuntu/ghostscript$
The resulting PDF file is correct though.
