I see what you are saying - i810 is an inferior driver to intel, crash issues aside. However, at the same time, shipping a driver known to hard crash randomly upon doing such common things as logging out or suspending to RAM seems irresponsible.
I feel that Ubuntu should go back to i810 as default for the Gutsy release - it worked in Feisty, and while it may have less features than intel, at least it doesn't hard crash regularly. *However*, Ubuntu could then push as an update to Gutsy a stub package which pushes the users to the intel driver once it is free of critical crashes.
