Mutale guards Solicitor General By Grace Matsiko & Zurah Nakabugo June 1, 2004 KAMPALA - The Solicitor General, Mr. Lucian Tibaruha, is now guarded by Maj Kakooza Mutale�s guards. This follows a threat of arrest by the Inspector General of Government Jotham Tumwesigye. Mutale is the Special Presidential Adviser on Political Affairs. The warrant of arrest against Tibaruha was issued at the weekend after he allegedly failed to respond to the IGG�s summons. The guards from, Mutale�s Special operations Unit, have been deployed at Tibaruha�s office on Parliament Avenue and his residence at Acacia Avenue, Kololo. Military Police personnel had on Friday been called in to beef up Mutale�s men to forestall a possible arrest of Tibaruha, according to State House sources. The guards pitched camp at Tibaruha�s office the whole day and at his home through the weekend until yesterday morning. Tumwesigye accuses Tibaruha, now the acting Attorney General, of refusing to respond to summons in connection with an intended payment of Shs 13 billion as compensation to Mr James Musinguzi, a Kampala businessman and Reform Agenda member. Musinguzi wanted the Government to compensate him for his ranch in Rakai, which was given to settlers. Mutale said yesterday if the IGG went ahead to arrest Tibaruha, it would cause a constitutional crisis. �If the IGG dares to arrest the acting Solicitor General without the express consent from the President, that would be creating a constitutional crisis that would create a direct route to have the IGG arrested,� Mutale said. �In my opinion, the IGG is reacting too much out of the provisions of the Leadership Code. The State can�t surrender its responsibilities to any person otherwise everybody will be up and say I am arresting you,� Mutale, said. �After the ruling of the Constitutional Court, the IGG has no powers to begin indulging in areas that he has been prohibited from. Mr. Tibaruha is the Acting AG. He is a member of the cabinet and very influential too,� Mutale said. �He has no powers to order for the AG�s arrest when he pursues that with total disregard of the inter-ministerial code of conduct. For example no minister can order for the arrest of another without the consent of the President,� Mutale added. Mutale was sacked last year, on recommendation of the IGG. The IGG said Mutale had failed to disclose his wealth in accordance with the Leadership Code. The High Court recently ruled that Mutale�s dismissal was based on wrong grounds. A State House official yesterday said Tibaruha wrote to the IGG saying he would not answer his summons because of the assignments he had at the time. �With effect from March 8, 2004, I will be out of station for one week on official duties,� Tibaruha had written to the IGG.
