Court summons 3,000 Baganda landlords

KAMPALA - The High Court has summoned at least 3,000 absentee Baganda landlords in the two "lost counties" of Buyaga and Bugangaizi in Kibale district.

The court issued the summons on December 14.

 

The court asked the landlords to file their defence against accusations that they violated the rights of Banyoro residents there by taking away their land fraudulently.

They are required to answer the summons by today.

Justice Okumu Wengi presides over the matter.

 

The summons were copied to the High Courts in Kibale, Kagadi, Hoima and Masindi.

The 3,636 landlords are jointly sued with Britain and the successive Uganda governments since independence, the Kabaka of Buganda, the Uganda Land Commission.

 

Britain is Uganda�s former colonial master. The complainants are represented by 11 residents, all from Kibale in Bunyoro.

Mr Ayena-Odong is prosecuting their case .

The! y want court to nullify the 1900 Buganda Agreement with the British, which portioned out the said land in Kibale to the Baganda landlords.

They want court to nullify the 1972 and 1993 settlements at Ruteete in Buyaga and Kisiita in Bugangaizi.

 

They claim that in 1890, the British Crown, assisted by the Kabaka of Buganda as a collaborator, invaded Kibale and looted property.

The complainants contend that the agreement between the British Crown and the Kabaka dated March 10,1900 forcefully gave away Bunyoro Kingdom land to Buganda.

The High Court on December 14, 2004 summoned over 4,000 Baganda absentee landlords in Buyaga and Bugangaizi counties over human rights violation.

 

Residents of Kibaale district accuse the landlords of violating their rights at the close of the last century, when British and Baganda troops invaded Bunyoro-Kitara kingdom, where they pillaged and killed over two million Banyoro.

 

The British Queen�s government refused to submit to Uganda jurisdiction. The British High Commission in Uganda quoted diplomatic immunity.

 

But the Kabaka of Buganda and the Government have submitted their defences.

 

The Uganda Electoral Commission and the Uganda Land Commission have not submitted their defences.

 

For the accused who have refused to submit their defence, the Banyoro, through Ayena Odongo and Company Advocates, have applied to the High Court allow them to proceed with the case against all accused regardless of whether they submit their defence or not.

 

However, it is not known how the High Court will deal with the absentee landlords who were served notices on its notice boards at Kibaale, Kagadi, Hoima and Masindi.

 

The orders are signed by the High Court�s Deputy Registrar.

Buyaga and Bugangaizi were won by Bunyoro in a legal battle with Buganda.
