The long thread on the incubator general list is concluding that these files don't need to be at the top level to meet the legal requirements, but the convention is to have them there, and if they are not there, some reviewers think they're missing.
It seems to me we could move them with little effect, except for one issue: they couldn't be managed using the Eclipse for SVN checkout / update/ commit tools (because they're not in a project). Any other thoughts? -Marshall
