It’s my understanding that if a list (or Web site or online forum) is moderated, the moderator assumes legal responsibility and liability for content. Isn't that so?
As Scottish Law puts it "not proven."
Sometimes yes and sometimes no. It depends on who the lawyers are.
(I assume you are referring to the "common carrier" effect, which has been decided both ways.)
