On November 19, 2004 the Senate Appropriations Committee added a section to� House Bill 1954 that removes�third-party�taxpayer (i.e. -- people not directly impacted by the ruling) standing to appeal zoning decisions in Philadelphia. here's the precise wording:
THE ACT IS AMENDED BY ADDING A SECTION TO READ:section 17.1 Specific powers -in addition to any aggrieved person, the governing body vested with legislative powers under appeal any charter adopted pursuant to this act shall have standing to appeal any decision of a zoning hearing board or other board or commission created to regulate development within the city. As used in this section, the term "aggrieved person " does not include taxpayers of the city that are not detrimentally harmed by the decision of the zoning hearing board or other board or commission created to regulate development.

Personally, I'm in favor of this clause because I think too many non-involved do-gooders are interfering with what people affected by such rulings want or need. This was originally the Billboard Association's wording to prevent Community Organizations from protesting the placement of any Billboard at any location in the city.
Note that the intent of this provision is to prohibit ANY Community Organization of any kind from opposing any Zoning change for any reason whatsoever. This includes any kind of City Planning Commission or similar entity.
Once again -- Pay to Play rears its ugly head -- "vested with legislative powers" means your paid-for City Council Representatives ONLY!!!
