O.k., I see. Then again I would say: If you have such an old browser, you are 
used to a mediocre browsing experience. So I would not care too much about 
that. In addition if you load your JS after the page is setup, the user might 
already click on something that does not work yet, e.g. an image gallery.

To get back to your suggestion, if I really would go through this hassle, I 
would probably "duplicate" the jsFiles mechanism in something like 
footerJsFiles. You will need custom model classes for this however.
