I thought the rpms had  a dependancy of apache-1.3.9 or something... 

You could download the source rpms - have a look at building RAQ rpms - modify
the spec file for apache dependecies - 

Or just complile from source = you should be able to follow the build
instructions on the midgard manual..

It did, but It had a habit of finding bugs in the midgard backend :)
