This condition implies that if HKLC has appointed a local distributor,
no one else may tender for a website content management services
contract without their permission (responding to a tender is a very
direct form of promotion).

Since my university is about to tender for a content management
software + services contract, that would rule out Midgard + nadmin,
as we would require someone fairly local to configure and maintain
the system, not just the European distributor appointed by HKLC.

It's hard enough getting them to write a tender that provides a level
playing field between commercial software and open source software,
without people coming up with semi-commercial licences to confuse
things further.
