Could be there's still an apache running.

Some server is allready using above port. It's not too likely to be
anything else than an existing apache.

It's dependant on how mysql was compiled where my.conf should be
located. But if you've installed mysql from packages it's very
reasonalbe to assume /etc.

Did you also specify the my.conf line in the [client] section?
