Thunderbird's philosophy seems to be that the occasional error is okay so long as it's just an error message. I imagine the developers discussing: "Hm, we don't know yet at this point in the code whether it's legal to send UNSELECT" "well, if we send it and it isn't legal, does anything bad happen?" "no..." "then let's just send it".
I rather agree with them, even if it does lead to a few error messages in the logs.
