There's a simple matter of enforcement. I can put a sign in my front yard:

And there isn't anything anyone can do so long as it isn't obscene or
violate some local zoning ordinance. They can scream "private prosecution"
til the cows come home, but there isn't anything tangible anyone can do.
It's my propertry.
If on the other hand "private prosecution" is simply a code word for public
ostracism, that's fine too. I'd just as soon people like that ignore me.
Now back outside to work. It's a beautiful sunny 18 degree day here in
Southeast PA, and throwing an extra 50 mm of mulch on my gardens.
