I believe he was tried but then overturned because the law actually says that his actions are correct.

He was convicted by a Magistrate of theft and criminal damage. The charge of theft was overturned on appeal by a more stringent interpretation of theft put up by the defence (he wrote and told them afterwards that he had removed the signs and offered to return them on the condition they would not be used again). The charge of criminal damage was upheld but he was let off because the amount of damage was judged to be minimal.

The fact that the charge of criminal damage was upheld in principal disproves the claim that his actions were lawful. Had the damage been more extensive (such as it was on other occasions) and he hadn't acted as he did after nicking the signs (like some of the other idiots acting under his incitement) he would have faced the full force of the law.

It was a sad day when those judges niavely let this guy off scot free arguably not knowing what he was really up to. It was nothing short of a vigilante's charter.
