Pretty much. It's similar to someone who loses their CD's in a fire and uses LimeWire to download songs that he/she already owned at one time. As the courts have found, LimeWire and other such programs are legal, and can be used for both legal and illegal purposes. I submit that both of these are legal (as I use the MP3 in the same manner as would be allowed by the restrictions on the AAC file).
