Yes, I would have to say it does rule out those restrictive licenses and it was lifted from the OSI's definition.

 I think that it was important to give a clear definition as to the type of software the document is referring to.  If the State is using a restricted license it will need to strictly adhere to all of the restrictions.

I know this is lifted word-for-word from the OSI's definition, and
they obviously approve of the GPL. But in general the GPL *does*
prevent you from distributing software "as a component of an aggregate
software distribution containing programs from several different
sources," right? I guess the subtlety here is what counts as a
"distribution." I most naturally read that as "code that will be
compiled and linked together," in which case it would rule out the
GPL. But I guess they must mean it in the sense of "GNU/Linux
distribution," in which case the GPL is obviously fine.

Hope that doesn't trip up anyone in state government...
