This is true for most 'first world' countries, however there are some
third world countries that the patent will apply until 2007. If there
is any chance that the application or the graphics that it creates
would be used in any of these countries then you risk violating the
patent.

Myself, I'd rather not risk it (even if they've never really made an
issue out of it for people like us). Besides, there are numerous
alternatives that are open source and unrestricted in use in any way.
Why tie yourself to the one that risks implied legal complications?
