I agree ... I'm fine with an opt-out system so long as the 'in state' is designed to be in compliance with the license associated with the feed.
I have no problem with people syndicating my stuff. I put it in a feed for a reason ... HOWEVER, there is still a license attached, thankfully all the information someone would need to stay within the bounds of the license is included in the feed.
I think these checks and balances were just left out on some systems.
