Hello Rebecca,

We have this seen this on perhaps 27 items since 2009.  These items included 
CD-ROMs, PDF titles, and videos.

In the past, we had several instances where titles were purchased and then the 
vendor contacted us about pricing, licensing, etc., because they had not 
thought about libraries purchasing from their websites.  We now try to get a 
copy of any licensing restrictions in writing from the vendor, either in a 
contract or in an e-mail, before making the purchase.

I recently bought some very expensive DVD titles at the institutional rate and 
was told by the vendor that they cannot be loaned out via ILL.  How often are 
you told this?  Is that legal?  Does it need to be included in the contract or 
invoice to be valid or is the verbal word sufficient to limit our use?
