There has long been a push by documentary filmmakers to be far more
aggressive on fair use and clips. The main problem has been major
distributors are basically afraid of being sued over use of a clip from a
studio film without clearance and most broadcast, cable wont' touch it.It
would certainly SEEM to fall under "fair use" but because it does often
involve "for profit" (though few make any profit) ventures that are not
educational (even if they may well be used for educational purposes) it is
uncharted territory.
