Hi deg, when we make a section 108 copy the cataloging record notes it. For
example with a note like this:

Originally issued as a videocassette in 1970. Recorded as a DVD in March 2014
for archival purposes in compliance with section 108 of the U.S. Copyright Act.

I use a very helpful 108 checklist provided by Chris Lewis at American Univ Lib
to document 108 decisions. I keep that on file along with documentation of the
search for rights.

I do use 108 very rarely and after a search for a rights holder has been
exhausted. Also only with high use legit VHS tapes that are becoming damaged
from high use.

Question about your cataloging policy:

If you have invoked US Copyright Law Section 108 to make a copy of a video in
your collection, do you provide a catalog record for the copy/ies?

If so, does the catalog record contain a reference to Section 108?

Thanx.

Feel free to respond off list if you wish.
