What he does for himself is not an issue but the copyright law is very
clear that a copy has to be part of libraries own collection in order to be
legally transferred  to digital copy and clearly this copy is not .The
library can not use a personal copy and transfer it and while I suspect
someone would suggest it, the law is clearly for material that the library
has acquired not some quickie "donation" to skirt the law.

Not every film ever released on VHS ( or DVD) is going to be available for
a library or institution to use. It is the legal equivalent of bringing in
an out of print ( but not out of copyright) book and asking you to make
photocopies for him to pass out to students and to also make a photocopy
for the library to put in the collection.
